
Milford City Council approved a request from the Trinity Development Center for a waiver related to an awning constructed on the building. The awning was constructed in a right-of-way on Southwest Front Street.
“Code Enforcement issued a notice violation back in May for this unlawful construction as there was no building permit issued. As a result, the owner submitted a building permit application for the awning, and upon review by planning department staff, it was determined the awning was located within the public right of way,” Rob Pierce, City Planner said. “Construction of this awning would require the execution of a license agreement for which we have we have done license agreements in the past for things like ADA entrance ramps that are constructed kind of out in front of a building within the public sidewalk are. There are just some restrictions, and we have to document granting permission.”
Councilman Dan Marabello stated that he had no issue with the waiver but was concerned that the project began without proper permitting.
“I do when the work is done before approval, and hopefully we can make sure that doesn’t happen too frequently,” Marabello said. “That’s all. Just requesting that we make sure that doesn’t get repeated, at least by the same real estate company.”
Mayor Todd Culotta pointed out that the building was purchased by Craig Aleman who had done a lot of work on buildings in the city.
“They’ve done a lot for downtown. They’ve bought four or five buildings already, and made a great investment in those buildings,” Culotta said. “So yes, you know, we want to stay ahead of what’s done before a permit, but this they’re very good for downtown.”
Council approved the waiver request unanimously.
